1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you and MinistryMind (“we,” “our,” or “us”) governing your access to and use of the MinistryMind mobile application for iPhone and iPad and our website at ministrymind.co (the “Service”).
By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
2. Description of Service
MinistryMind is an AI-powered application that helps ministry leaders, educators, and individuals create biblical content including sermons, devotionals, and lessons. Our Service includes:
- AI-assisted content generation for sermons, devotionals, and lessons
- Bible search functionality with scripture references
- Content history and management
- Sharing and export of the content you create
3. Account Registration
3.1 Account Creation
To use our Service, you must create an account by providing accurate and complete information, including your email address and password. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Account Responsibilities
You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
3.3 Age Requirements
You must be at least 16 years old to create an account and use the Service. By creating an account, you represent that you meet this age requirement.
4. Subscription and Payments
4.1 Free Tier
We offer a free tier with limited content generation capabilities. Free tier users may generate one sermon, one devotional, and one lesson every 30 days.
4.2 Premium Subscription
MinistryMind offers a premium subscription called MinistryMind Pro. This is an auto-renewable subscription with a duration of 1 month, priced at $9.99 per month (USD). The subscription provides unlimited access to all content generation features, including sermons, devotionals, and lessons.
Your MinistryMind Pro subscription will automatically renew at the end of each 1-month billing period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. By subscribing, you agree to recurring billing. 4.3 Payment Processing
Payments are processed by Apple through In-App Purchase. Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription is subject to Apple’s Licensed Application End User License Agreement.
4.4 Cancellation and Refunds
You may cancel your subscription at any time:
- Go to your device Settings → tap your name → Subscriptions → select MinistryMind Pro → Cancel Subscription. You can also manage subscriptions through the App Store. Cancellation takes effect at the end of the current billing period.
Upon cancellation:
- Your subscription will remain active until the end of the current billing period
- You will not be charged for subsequent billing periods
- No refunds are provided for partial months or unused portions of the subscription
- Refund requests for App Store purchases must be directed to Apple
4.5 Price Changes
We reserve the right to modify subscription prices. We will provide at least 30 days’ notice before any price increase takes effect. Continued use of the Service after a price change constitutes acceptance of the new pricing.
5. Acceptable Use
5.1 Permitted Use
You may use the Service for personal, educational, and ministry purposes to generate biblical content such as sermons, devotionals, and lessons.
5.2 Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Generate content that is hateful, discriminatory, harassing, or promotes violence
- Attempt to bypass or circumvent usage limits or security measures
- Share your account credentials with others or allow unauthorized access
- Use automated systems, bots, or scripts to access the Service without permission
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Interfere with or disrupt the integrity or performance of the Service
- Impersonate any person or entity or misrepresent your affiliation
- Collect or harvest user data without authorization
- Use the Service to generate content for commercial resale without permission
6. Content and Intellectual Property
6.1 Your Content
You retain ownership of the input you provide to generate content (topics, scripture references, preferences). The AI-generated output (sermons, devotionals, lessons) created through your use of the Service is licensed to you for your personal, educational, and ministry use.
6.2 License to Generated Content
We grant you a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute the content generated through your use of the Service for your personal, educational, and ministry purposes, including:
- Delivering sermons and lessons to your congregation or audience
- Sharing devotionals in ministry communications
- Adapting and customizing generated content for your specific needs
- Publishing content in church bulletins, newsletters, or websites
6.3 Our Intellectual Property
The Service, including its design, features, functionality, and underlying technology, is owned by MinistryMind and protected by intellectual property laws. You may not copy, modify, or create derivative works based on the Service itself.
6.4 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation to you.
7. AI-Generated Content Disclaimer
Important: Content generated by MinistryMind is created using artificial intelligence and should be reviewed before use. While we strive for accuracy and biblical faithfulness:
- AI-generated content may contain errors, inaccuracies, or theological perspectives that differ from your beliefs
- You are responsible for reviewing, editing, and verifying all generated content before use
- Generated content should not be considered a substitute for personal study, prayer, and theological discernment
- Scripture references should be verified against authoritative Bible translations
- We do not guarantee that generated content aligns with any specific denomination or theological tradition
You acknowledge that you use AI-generated content at your own discretion and assume full responsibility for how you use, modify, and present such content.
8. Privacy
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you agree to our Privacy Policy.
9. Disclaimers
9.1 “As Is” Basis
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9.2 No Guarantee
We do not guarantee that:
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from the Service will be accurate or reliable
- Any errors in the Service will be corrected
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINISTRYMIND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or goodwill
- Service interruption or computer damage
- Cost of substitute services
- Any damages arising from your use of or inability to use the Service
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless MinistryMind and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you generate, modify, or distribute using the Service
12. Modifications to Service and Terms
12.1 Service Changes
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable for any modification, suspension, or discontinuation of the Service.
12.2 Terms Changes
We may revise these Terms at any time. We will provide notice of material changes by posting the updated Terms and changing the “Last updated” date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
13. Termination
13.1 Termination by You
You may terminate your account at any time from within the app or by contacting us. Upon termination, your right to use the Service will cease immediately.
13.2 Termination by Us
We may suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
13.3 Effect of Termination
Upon termination, your license to use the Service terminates. Sections that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, limitations of liability, and indemnification.
14. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.
Any disputes arising from or relating to these Terms or the Service shall be resolved through good-faith negotiations. If negotiations fail, disputes shall be submitted to the exclusive jurisdiction of the courts in the Netherlands.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MinistryMind regarding the Service.
15.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
15.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
15.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
